There are different requirements for physicians who want to work with patients and for physicians who primarily want to teach or research.

Physicians who want to treat patients must have passed a Health and Human Services - approved examination AND be competent in English (demonstrated by passing English proficiency test given by the Educational Commission for Foreign Medical Graduates) or have graduated from a medical school accredited by the US Department of Education.

Physicians who will be teaching or conducting research must do so for a public or non-profit private educational research institution. No patient care, other than that which is incidental to the teaching or research, can be performed.

Before international medical graduates (IMGs) can receive licenses from the state in which they want to practice, they must complete a residency program in the US. Most do so by entering the country as a non-immigrant exchange visitor under a J-1 visa. When their US residency is complete, IMGs must return to their countries of citizenship or last residence for two years (although waivers can often be obtained) before returning to the US as a temporary worker with an H or L visa or as a permanent resident.

H-1B for Physicians

In order to be eligible for an H-1B, a doctor must be licensed in the jurisdiction where s/he will be practicing. S/He must have graduated from medical school and have passed either the Federal Licensure Examination (FLEX) or the equivalent US Medical Licensing Examination (USMLE). It is important that all the three steps of USMLE exam must be completed. Reference letters are also often required.

Any foreign doctor who wishes to shift to H-1B status after acquiring a J-1 waiver must change to H-1B status within 90 days of getting the waiver approval. Therefore, it is important to have all the required documentation well in advance, to avoid going through the H-1B visa being denied. If the J-1 holder goes beyond his/her 30-day grace period, s/he must apply for the H-1B visa at the consulate.

The petitioner or self-petitioner must submit evidence with Form 1-140 to support the request for a national interest waiver. For petitioners planning to divide the practice of full-time clinical medicine between more than one underserved area, the evidence must be submitted for each of intended practice.

O-1 visa, meant for people with 'extraordinary ability' is being checked thoroughly. Moreover, employers who sponsor such visa may keep their physicians indefinitely on O-1 rather than sponsoring their permanent residence.

Two Bills Have Been Introduced, One By U.S. House Of Representatives Democrat On The Science And Technology Committee Which Gates Had Addressed And Another By A House Republican. Both Bills Propose To Raise The H1b Quota By 2008.

H1b Is A Visa Category That Allows Us Employers To Bring In Aliens With At Least A Bachelors Degree And Specialized Skills To Work In Special Occupations (Programmers, Scientists Etc). The Second Bill Was Proposed By Lamar Smith, A Ranking Member Of House Judiciary Committee From Texas. The Bill, Called The Strengthening United States Technology And Innovation Now (Or Sustain) Act, Proposes To Raise The Visa Cap To 195,000.

Why The Hike?

Both Bills Follow Bill Gates&Rsquo; Plea, Which Is Echoed By Many Other Technology Companies, Which Pointed To A Visa Shortage Crisis. These Companies Argue That They Are Facing Severe Shortage Of Specialized Workers As There Aren&Rsquo;T Many Qualified Americans. Countering Some Of The Usual Criticism Faced By H1b, Gates Stated In His Addresses That By Hiring H-1B Workers Microsoft Is Actually Preventing Jobs From Being Moved Offshore And Also Creating More Jobs For American Programmers And Engineers&Rsquo; Junior Level.
